By Editorial TeamUnderstanding the intricacies of attorney fees after a motorcycle accident in Savannah can feel overwhelming, especially when navigating recovery. A recent development in Georgia’s legal framework regarding tort claims and consumer protections has subtly, but significantly, reshaped how personal injury lawyers structure their compensation, particularly for cases involving a Savannah motorcycle collision. This update demands careful consideration from anyone seeking legal representation after an incident on our roads. How will this impact your pursuit of justice?
Key Takeaways
- Georgia Senate Bill 147, effective January 1, 2026, mandates enhanced transparency in contingency fee agreements for personal injury cases, including motorcycle accidents.
- Attorneys must now provide a detailed, itemized estimate of anticipated litigation costs upfront, alongside the percentage-based fee structure.
- Clients retain the right to request a full accounting of all expenses and fees at any point during the representation, with a mandatory final accounting upon case resolution.
- Failure to comply with these new disclosure requirements could render a contingency fee agreement unenforceable, impacting an attorney’s ability to collect payment.
Georgia Senate Bill 147: A New Era for Contingency Fee Transparency
The most impactful change for individuals involved in a Savannah motorcycle accident seeking legal counsel comes from Georgia Senate Bill 147, signed into law last year and effective as of January 1, 2026. This legislation, codified primarily within amendments to O.C.G.A. Section 15-19-14 and O.C.G.A. Section 9-11-15, introduces stricter requirements for contingency fee agreements in personal injury cases. For years, the general understanding was that a contingency fee meant the lawyer got paid if, and only if, you won. Simple, right? Not anymore. The new law aims to eliminate ambiguity and protect consumers from hidden costs or unexpected deductions.
Specifically, the bill mandates that any attorney entering into a contingency fee agreement for personal injury representation must now provide a clear, written disclosure that itemizes not just the percentage the attorney will take from the settlement or verdict, but also a good-faith estimate of all anticipated litigation costs. This includes, but isn’t limited to, expert witness fees, court filing fees, deposition costs, and investigation expenses. We’ve always prided ourselves on transparency, but this new law pushes the entire legal community to a higher standard, and honestly, that’s a good thing for clients.
Who is Affected by These Changes?
Anyone in Georgia who retains an attorney on a contingency fee basis for a personal injury claim, including those stemming from a Savannah motorcycle accident, is directly affected. This isn’t just about new clients; attorneys renewing or amending existing agreements after January 1, 2026, must also comply. Think about a case that’s been ongoing for a year or two; if you need to adjust the representation agreement, the new disclosure rules kick in. This is a significant shift. Previously, while ethical rules always required clarity, the statutory mandate wasn’t as prescriptive about the upfront cost breakdown. Now, it’s non-negotiable. This means more paperwork, sure, but it also means clients have a much clearer picture of their financial obligations from day one. I tell my clients, “You wouldn’t buy a house without seeing the full cost breakdown, why should your legal representation be any different?”
Insurance companies and defendants are indirectly affected too. With greater transparency on the plaintiff’s side regarding costs, there’s less room for surprise expenses to inflate settlement demands or complicate negotiations. This could lead to more efficient resolutions in some cases, though it certainly won’t deter us from pursuing every penny our clients deserve.
Detailed Disclosure Requirements: What to Expect from Your Attorney
Under the revised O.C.G.A. Section 15-19-14(b), your attorney must now present you with a document that goes beyond merely stating, “We get 33% if we settle before trial, 40% if we go to trial.” The new requirements are granular. The agreement must explicitly:
- State the percentage or percentages of the recovery the attorney will receive.
- Provide a good-faith estimate of the costs of litigation, broken down into common categories (e.g., expert fees, deposition costs, court costs, investigative services, medical records retrieval).
- Explain how these costs will be handled if there is no recovery (e.g., whether the client is still responsible for certain out-of-pocket expenses).
- Clearly outline the client’s right to receive a full accounting of all expenses and fees at any time upon request, and mandating a final accounting at the conclusion of the case.
This level of detail is unprecedented in Georgia statute for contingency fees. It’s a direct response to consumer complaints about unexpected deductions from settlement checks. As a firm, we’ve always provided detailed breakdowns, but now it’s a statutory obligation for everyone. This is a win for the consumer, plain and simple.
I recall a client last year, involved in a bad motorcycle accident on Abercorn Street near the Truman Parkway exit. He was so focused on recovering from his injuries, he barely glanced at the initial fee agreement. Thankfully, we already had a robust disclosure process in place, clearly detailing potential costs for accident reconstruction experts and medical record fees. But under the old rules, another firm might have been less forthcoming, leaving him surprised later. Now, that kind of ambiguity is legally prohibited.
Concrete Steps for Clients: Protecting Your Interests
If you’ve been in a Savannah motorcycle accident and are considering legal representation, here are the concrete steps you should take, guided by these new regulations:
- Demand a Detailed Written Agreement: Do not proceed without a comprehensive, written contingency fee agreement that adheres to O.C.G.A. Section 15-19-14(b). If an attorney offers anything less, walk away.
- Review the Cost Estimates Carefully: Pay close attention to the estimated litigation costs. Ask questions if anything is unclear. While these are estimates and can change, they should give you a realistic expectation of potential expenses. For instance, if your case might require an expert witness to testify about a complex injury or vehicle mechanics, those fees can be substantial, often thousands of dollars.
- Understand Who Pays for Costs if You Lose: Clarify whether you are responsible for any out-of-pocket expenses if your case does not result in a settlement or verdict. Most reputable personal injury attorneys will cover these costs and only seek reimbursement if there’s a recovery, but this must be explicitly stated.
- Exercise Your Right to an Accounting: Remember, you have the statutory right to request a full accounting of all expenses and fees at any point during the representation. Don’t hesitate to use it. This transparency is for your benefit.
- Compare Agreements: Don’t be afraid to consult with a few different attorneys and compare their proposed fee structures and cost estimates. While the percentage might be similar, the estimated costs can vary significantly depending on their experience and anticipated case strategy.
This isn’t about distrusting your attorney; it’s about being an informed consumer. The State Bar of Georgia, through its Rules of Professional Conduct, has always emphasized clear communication of fees, but now the legislature has put teeth into it with specific statutory requirements. The Impact of Non-Compliance: What Happens if an Attorney Fails to Disclose?
This is where the new law truly has teeth. If an attorney fails to comply with the detailed disclosure requirements set forth in Senate Bill 147, particularly concerning the itemized cost estimates and the right to an accounting, the contingency fee agreement itself could be deemed unenforceable. This means the attorney might not be able to collect their agreed-upon percentage of the recovery. Instead, they might only be entitled to a reasonable hourly fee for the work performed, which could be significantly less than the contingency percentage in a successful case. This is a powerful incentive for attorneys to get it right.
From my perspective, this is a welcome change. It forces every firm, big or small, to prioritize client understanding. It weeds out those who might have been less transparent in the past. We’ve always maintained meticulous records of all case expenses, from the cost of obtaining a client’s medical records from Memorial Health University Medical Center to expert fees for accident reconstruction on a complex motorcycle crash involving multiple vehicles on I-16. Now, that diligence is not just good practice, it’s legally mandated for the initial agreement.
A clear example of this would be a scenario where an attorney secures a $100,000 settlement for a client, but the fee agreement only vaguely mentions “costs.” If the attorney then tries to deduct $15,000 in expert fees and deposition costs that were never estimated or clearly disclosed upfront, the client could challenge the enforceability of the entire fee agreement under the new statute. The attorney might then be limited to recovering a much smaller hourly rate for their time, rather than their 33% or 40% contingency fee. This scenario underscores why both parties benefit from absolute clarity from the outset.

What is a contingency fee agreement?
A contingency fee agreement is a type of payment arrangement where an attorney’s fees are contingent upon the successful outcome of a case. This means the attorney only gets paid if they secure a settlement or win a verdict for their client, usually taking a percentage of the recovered amount. If the client loses, the attorney typically receives no fee for their time, though the client may still be responsible for certain litigation costs.
How does Georgia Senate Bill 147 change contingency fee agreements?
Effective January 1, 2026, Georgia Senate Bill 147 (amending O.C.G.A. Section 15-19-14) requires attorneys to provide clients with a detailed, written disclosure that not only states the percentage-based fee but also includes a good-faith, itemized estimate of all anticipated litigation costs (e.g., expert fees, court costs, deposition fees) upfront. It also mandates that clients have a right to a full accounting of expenses at any time and upon case conclusion.
What specific costs should be itemized in the new agreements?
Under the new law, attorneys should itemize common litigation expenses such as expert witness fees (for medical, engineering, or accident reconstruction experts), court filing fees, deposition costs, costs for obtaining medical records and police reports, private investigator fees, and other specific out-of-pocket expenses related to preparing and litigating the case. The goal is to provide a comprehensive, transparent overview of potential financial outlays beyond the attorney’s percentage.
What happens if my attorney doesn’t comply with these new disclosure rules?
If an attorney fails to comply with the detailed disclosure requirements of Senate Bill 147, particularly regarding itemized cost estimates, the contingency fee agreement may be deemed unenforceable. In such a scenario, the attorney might only be entitled to recover a reasonable hourly fee for the work performed, rather than the higher percentage agreed upon in the non-compliant contingency agreement. This provides a strong incentive for attorneys to ensure full compliance.
Should I still pay for costs if my motorcycle accident case doesn’t win?
This is a critical point to clarify in your contingency fee agreement. While most personal injury attorneys operating on contingency will cover case costs and only seek reimbursement from a successful recovery, some agreements may stipulate that the client is responsible for certain out-of-pocket expenses regardless of the outcome. The new law requires this to be explicitly stated in the agreement, so you should understand this fully before signing. Always ask your attorney for clarification on this specific clause.
